Terms of Service

These Terms of Service govern your access to and use of bernieresandblueiris.ca and your dealings with Bernières & Blue Iris.

Eligibility and Acceptable Use

You must have legal capacity to enter into a binding agreement or use the website with the permission and supervision of a parent or legal guardian.

You must not:

• Use the website for unlawful, fraudulent or abusive purposes;
• Interfere with the website’s operation or security;
• Introduce malicious code or attempt unauthorized access;
• Scrape or commercially exploit website content without permission; or
• Submit false, misleading or infringing material.

Product Information

We take reasonable care to present descriptions, images, colours, dimensions and prices accurately. Screen settings, manufacturing variations and natural materials may cause minor differences.

We will not make false or misleading representations or omit an important fact concerning a product.

Distance Contracts

Before a Quebec consumer completes an online purchase, we will clearly disclose the information required by law in a form that can be retained and printed.

Customers will have an opportunity to accept, correct or reject the order before purchase. A complete copy of the contract will be provided within 15 days after the purchase.

Orders

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. A binding sale is formed when we send confirmation that the order has been accepted or dispatched.

We may decline or cancel an order before acceptance because of stock unavailability, payment failure, suspected fraud, delivery restrictions or another lawful reason.

Any correction of an advertised-price error is subject to the Quebec Consumer Protection Act and applicable pricing rules.

Prices and Taxes

Prices are displayed in Canadian dollars unless otherwise stated. Advertised prices will include the amounts consumers must pay to obtain the product, except amounts that may lawfully be excluded, such as applicable GST and QST.

Applicable taxes, delivery charges and other permitted costs will be disclosed before the order is submitted. We will not charge a higher price than the advertised price except where permitted by law.

Payment

Payment methods offered before delivery will comply with Quebec requirements. Where advance payment is collected, it will generally be processed by credit card unless another method is permitted by law.

Delivery, Returns and Refunds

Delivery is governed by our Shipping Policy. Returns and remedies are governed by our Refund and Return Policy and all applicable statutory rights.

Promotions

Promotions may be subject to specific conditions, availability and expiry dates. Promotional terms will not override mandatory consumer rights.

Intellectual Property

The website and its branding, text, photographs, graphics, software and other content are owned by or licensed to Bernières & Blue Iris. You may use the website for personal, non-commercial shopping purposes only.

User Content

If you submit a review, photograph or other content, you confirm that you have the right to do so and that it is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free licence to use and display it for operating and promoting our business. You retain ownership of your content.

Consumer Rights and Liability

Nothing in these terms excludes, restricts or modifies a legal warranty, consumer protection or remedy that cannot lawfully be excluded.

Any limitation of liability applies only to the extent permitted by law and does not apply to the consequences of our acts, fault or negligence where liability cannot legally be limited.

Disputes

Nothing in these terms requires a Quebec consumer to waive the right to bring a dispute before a Quebec court, participate in a class action or refuse arbitration before a dispute arises.

Language

French-language versions of contracts and related documents will be provided first where required by the Charter of the French language. The parties may expressly agree to be bound by an English version after the French version has been remitted where permitted by law.

Changes

We may revise these terms by publishing an updated version. Changes apply prospectively and do not remove rights already accrued or alter an accepted order without lawful consent.

Governing Law

These terms are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec, subject to mandatory consumer protections.
